Overview

These Terms and Conditions govern enrolment and participation in the AMELIA Pilot Foundation Online Course (“Course”), delivered by Airways Aviation Education Pty Ltd (“Airways Aviation”, “we”, “us”, or “our”). By enrolling in the Course, you agree to be bound by these Terms and Conditions.

Course Delivery

1. The Course is delivered 100% online via the AMELIA learning platform.
2. The Course is self-paced and accessible from any device with an internet connection.
3. No face-to-face training, assessment, or instructor-led delivery is included.

Enrolment and Access

1. Upon successful enrolment and full payment, students will be provided with login details to access the Course. Access is for one student only and is not transferable.
2. Access to the Course is granted for a period of twelve (12) months from the date of enrolment.
3. Access will end upon graduation or at the expiry of the enrolment period, whichever occurs first. Student accounts will be removed from the LMS after this time.
4. No extensions will be granted unless required under applicable Australian Consumer Law.

Fees and Payment

1. The Course fee must be paid in full prior to access being granted.
2. All fees are quoted in Australian Dollars (AUD) and include GST where applicable.
3. Failure to complete payment will result in no access to the Course.

Refunds and Consumer Rights

1. Refunds are not provided once access to the Course has been granted, except where required under the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law).
2. Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under Australian Consumer Law.
3. If the Course is found to be not of acceptable quality, not fit for purpose, or not as described, you may be entitled to a remedy under Australian Consumer Law.

Student Responsibilities

1. Students are responsible for ensuring they have appropriate technology, internet access, and digital literacy to undertake the Course.
2. Students must not share login details or allow access to third parties.
3. Students must use the platform and materials for personal educational purposes only.
4. Any misuse of the platform, including unauthorised distribution of materials, may result in termination of access without refund.

Intellectual Property

1. All Course materials, content, and platform resources remain the intellectual property of Airways Aviation or its licensors.
2. Students are granted a limited, non-transferable licence to access and use materials for personal learning only.
3. Reproduction, distribution, or commercial use of Course content is strictly prohibited.

Certification and Outcomes

1. A completion certificate will be issued upon successful completion of all Course requirements.
2. Completion of the Course may provide eligibility for entry into further training programs with Airways Aviation, subject to meeting all entry requirements.
3. The Course does not guarantee employment, licensing, or enrolment into other programs.

Technical Support

1. Technical support is available via email at amelia@airwaysaviation.com.
2. Support is limited to platform access and technical issues and does not include academic tutoring or instruction.
3. Airways Aviation will make reasonable efforts to respond to support requests in a timely manner.

Platform Availability

1. While Airways Aviation aims to ensure continuous access, we do not guarantee uninterrupted availability of the platform.
2. We are not liable for interruptions caused by system maintenance, upgrades, or factors outside our control.
3. Reasonable steps will be taken to minimise disruption.

Privacy and Data Protection

1. Airways Aviation collects and manages personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
2. Personal information is collected for the purpose of enrolment, course delivery, student support, and compliance obligations.
3. Students’ information will not be disclosed to third parties without consent unless required by law.
4. Students may request access to or correction of their personal information at any time.

Limitation of Liability

1. To the extent permitted by law, Airways Aviation is not liable for any indirect, incidental, or consequential loss arising from participation in the Course.
2. Liability for breach of any non-excludable condition or warranty is limited, at our discretion, to the resupply of the Course or refund of the Course fee.

Termination of Access

1. Airways Aviation reserves the right to suspend or terminate access to the Course if a student breaches these Terms and Conditions.
2. No refund will be provided in cases of breach by the student.

Governing Law

1. These Terms and Conditions are governed by the laws of Queensland, Australia.
2. Any disputes arising under these Terms will be subject to the jurisdiction of the courts of Queensland.

Amendments

1. Airways Aviation reserves the right to update or amend these Terms and Conditions at any time.
2. Updated Terms will be made available via the platform and will apply to all enrolments from the date of publication.

By enrolling in the AMELIA Pilot Foundation Program, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
